‘Heads I Win, Tails You Lose’: In 9/11 Case, KSM Won’t Walk Free Even If Found Not Guilty

Attorney General Eric Holder acknowledged on Wednesday a previously unspoken proviso to the controversial decision to try alleged 9/11 mastermind Khalid Sheikh Mohammed and four co-conspirators in a federal court in New York: even if the defendants are somehow acquitted, they will still stay behind bars.

Snip

To Call what will transpire with KSM in New York a “trial” is absurd. It is a perversion of the rule of law. Even if the government by dint of holding the trial in the most defendant hostile venue possible ( just a few blocks from ground zero ) can not secure a conviction; if can not do this after Obama further poisoned the waters with his statement ( http://www.msnbc.msn.com/id/34015727/ns/us_news-security/) KSM will not go free if he is somehow acquitted. He will continue to be held under the made up legal rubric of “enemy combatant.” Sentence first, trail later.

OH!!! oh!!! OH!!!!!! You get the video upload award of the season. I’m so lovin’ this. heh-heh.

A *really* good article on this one is Patterico, who used to be a prosecutor. Saw it over @ Greenwald’s place:

    1) This president has proved in 9 short months he has not a clue what he is doing. To this post….as an “attorney” he should know better than to say what he said. Did the MSM cover this story correctly…once again absolutely not. If President Bush (who I have never been a fan of ) had made similar remarks, well we all know what would have happened.

    2) The Point of the Trial….the American public has no idea the differences in venue, charges, etc..all smoke and mirrors, political posturing and a huge waste of time. I saw the SOS asked about this decision and she did her best to dance, but to me anyway, it was clear she was not happy with this decision. On the flip side I believe that Sen. Schumer is now asking for a large some of federal money to be infused into the State of NY because of this decision. Do I smell dog shit somewhere?

Quite frankly I am embarassed to be an American right now. Much more so than in previous administrations. I concur with what djjl said on another diary… makes you want to move to another country. Actually I am not just embarassed, I am ashamed.

” Much more so than in previous administrations.”

While I am far from happy with what this administration has done to date this is so ridiculous on it’s face as to almost, almost but not quite, warrent comment.
So, what this administration has done is WORSE then having sat around with their collective thumbs up their asses and letting 9/11 happen? Is worse then lying to first responders about the danger of the air at ground zero? Is worse then lying to the American people and Congress and launching a war of aggression against a country that no matter how loathsome was NO threat to America? Using a basically mercenary army and allowing them to murder at will in that country? Instituting torture as state policy? Shredding the Constitution, that “God Damned piece of paper” the terrorist in chief refered to? Is worse then gutting the EPA? etc. etc. etc. etc. etc. etc. etc.
Sometimes you make statements that on reflection are about the hands down dumbest I have ever read here.

  4. The Bu$h administration who provoked The Talibam/Al Qaeda into attacking us on 9-11 did nothing about the impending attacks because they somehow naively hoped that the Taliban might come around and allow UNOCAL, who Hamid Karzai worked for, to build those oil and gas pipelines across Afghanistan. Then on 9-11 Bush got his answer to his threat of invasion by a preemptive strike by Taliban/Al Qaeda on 9-11 and Bush showed his surprised face as if he knew that he had gotten this final answer.

As for trials the mass murderer Charles Manson got tried in the US, got convicted and so far never got out to kill again after over 30 years.

The Washngton State Republican official Ted Bundy the mass murderer also got tried in the US and never got out to kill again and eventually got executed.

The conservative anti government killer Timothy McVeigh got tried and convicted in the US, and never got out to kill anyone else and got executed. His co conspirator conservative anti government Terry Nichols also got tried in the US and hasn’t got out to kill anyone.

So any wooooooooo woooooooooo woooooooo by the McCarthyite Republiklan party can get dismissed as fast as a batter struck out by 2 time NL Cy Young winner Tim Lincecum.

And what may I ask secular does this administration tell the truth about?

By the way — I don’t mind criticism of my remarks at all but I do take exception to being called dumb. I stopped the “personal” attacks with ogenec as I value his comments here and wish to see him at this site more often.

As for you, I won’t engage in the same garbage you do with me. Believe me my observations on your insights could get quite colorful. I respectfully request you stop.

    Kris,

The last administration started a WAR under false pretenses. 4,000+ US soldiers dead, 100,000+ Iraqis killed, pushing $2 trillion. Period, end of argument, that trumps anything that Obama has done up to now by a country mile.

As far as being up front about things:

    1. Bush’s director of Medicare, Thomas Scully, forced the Chief Actuary to lie about the cost of the Medicare precription drug coverage. Actuaries normally do high, medium and low estimates, they used substituted the low estimate for the medium. Not my opinion, the GAO investigated and determined that is what happeneded, Scully was fired and forced to re-pay part of his salary. Do you think he did this on his own.

    2. The politicization of the Justice Department. People were hired and fired based on their political leanings. We know this happened based on testimaony of multiple people.

    3. The Valerie Plame incident. Speaks for itself that the VP wanted to out a CIA agent.

    4. The budget lies. The costs of the Iraq and Afghanistan wars were “off-budget”, actually not included with the budget. I work in Finance, that’s not creative acconting, that’s just lying. If the US were a publicly-traded company, Bush’s budget director would have gone to jail.

    5. Katrina – Aside from having the eminently-qualified Michael Brown, former head of the American Quarterhorse Association, as head of FEMA, Bush, et. al. acted like the impending hurricane was a goddamn joke as it was moving toward New Orleans. maybe they wouldn’t have had a thousand dead if that shitbag Bush had acted like a president.

The Bush administartion was in a class by itself for the combination of deceit and incompetennce. To compare Obama, who inherited an economy that was easily the worse the Depression (almost universal agreement among economists and hsitorians) and two wars shows a delusional hatred of Obama.

Who knows, in 3 years you might get to vote for Palin, she sounds like your idea of an up front person.

  7. kris says:

    Myman -

We can keep backing up and review every previous administration and it wouldn’t be pretty for any of them. I think we can all agree on that point. And I have never defended the Bush Administration okay? So please give it a rest.

There are absolutely no “up front” people in politics imo and that is exactly what is wrong these days. Both Dems and Repubs have no interest in doing what is right for the working people in this country. The current Administration is incompetent at best particularly when it comes to economics. If you want to debate me on that point along I welcome it, however, Taylor better have enough space here for a very long argument.

As for Gov. Palin – you know absolutely nothing about me if you think I would vote for her.

  8. MyManJeeves says:

    Kris,

Administrations don’t put together policy in a vacuum. By necessity, virtually every policy decision of the Obama admin is in reaction to events that were in large part caused by policy decisions under Bush. In the case of foreign policy that can probably changed to every policy decision. The recession/near depression? Does anyone seriously beliece it would have been as bad if Bush hadn’t run up multi-trillion dollar deficits?

His chief policy strategist, Rove, left this country as divisive as possible. It doesn’t help that a significant portion of the GOP is just plain nuts. More than half of the whites in the south believe Obama was born in Africa. Half of the GOP thinks ACORN helped to steal the election.

And yes, I blame the Bush administration in large part for this divisiveness.

I don’t agree with some of the things Obama has done, but he is doing things for the long haul, not the next six months.

This strategy very well may not work, since large chunks of the American public are simply ignorant, and proud of it.

The last eight years under Bush happenned.

Kris, you have the most appropriate avatar I’ve ever seen if you have a mirror sitting in front of you. If you don’t want to see anyone saying you say dumb things stop saying dumb things.

  10. kris says:

I hear you secular. And I picked this avatar just for you because I knew you would appreciate it :-)

You annoy the shit out of me sometimes but I have nothing but respect for you. Not that you really care, but I just had to say it.

  11. kris says:

In all honesty I didn’t pick it just for you, but you were a part of it.

Don’t you think most of us here think we see dumb people? No one here is IMO, we just disagree at times. It really is a reflection of how I feel about the country in general these days.

  12. secularhumanizinevoluter says:

For the record I DID NOT say you were dumb. I said, and will continue to say whenever you say them, you said a dumb thing. Differance.
I have respect for the vast majority of posters here.
